Joel John, a sharp voice in the crypto speculation discourse, asked an honest question. The implied frame around it is the standard DeFi take: on one side, perpetuals on commodities and pre-IPO stocks. Productive speculation. A farmer hedging corn. Retail getting SpaceX exposure before the VCs cash out. Real economic risk being transferred, real price discovery happening. On the other side, sports gambling. Pure entertainment. Zero-sum. A vig-extracting machine that produces nothing but dopamine and regret.
The distinction feels intuitive. It feels correct. It’s also the reason Joel’s question is hard: if sports betting is just the predatory half of that split, what’s the case for it beyond “it’s a good business model”?
But I’ve spent enough time in DeFi to know that intuitive distinctions crumble under the weight of actual market data. And in April 2026, the data tells a story that complicates the clean line. Sports betting, reimagined through crypto rails, isn’t cleanly “productive” in the way commodity hedging is. But it’s not cleanly predatory either. It sits on a gradient, and the interesting question is where exactly it falls, and whether the trajectory matters more than the current position.

Let’s start with the number that changed the conversation.

Sportsbooks in 2019 were limited to a handful of newly legal states. Prediction markets launched with national access from day one, riding existing crypto and brokerage infrastructure. The scaling speed is real, but the starting conditions were fundamentally different.
There’s also a composition question that I think gets too little attention. Industry analysts note that a significant portion of prediction market volume comes from automated liquidity providers and high-frequency traders, not retail participants expressing genuine forecasting opinions. Volume and productive information aggregation are not the same thing, and the headline numbers don’t tell you how much of the activity is meaningful price discovery versus bot-driven churn.
The jurisdictional war
The reason prediction markets are growing faster than sportsbooks comes down to a single regulatory insight: they aren’t classified as gambling.
Event contracts traded on platforms like Kalshi operate as derivatives regulated by the CFTC under the Commodity Exchange Act. Kalshi holds the same Designated Contract Market status as the Chicago Mercantile Exchange. Under this framework, CFTC jurisdiction preempts state gambling regulation for registered exchanges. This is why Kalshi and Robinhood can offer sports contracts in all 50 states, including California and Texas, where traditional sportsbooks remain illegal. It’s also why the minimum age is 18, not 21.
This has triggered what I’d call the most consequential jurisdictional battle in U.S. financial law since the CFTC-SEC turf wars over crypto classification.
In April 2026, the CFTC, backed by the Department of Justice, filed lawsuits against Arizona, Connecticut, and Illinois, asserting exclusive federal authority over prediction markets. The suits came after more than a dozen states had attempted to restrict or ban these platforms, arguing they function as unlicensed sports betting operations. The courts are split. If you still think sports prediction markets are a niche crypto experiment, look at who’s writing the checks and, more importantly, what they’re building with them.
The headline number is ICE’s $2 billion commitment to Polymarket, the parent company of the New York Stock Exchange backing a crypto-native prediction platform. But the investment thesis is what makes it analytically interesting. ICE isn’t betting on prediction markets as entertainment. It’s a data infrastructure play. In February 2026, ICE launched “Polymarket Signals and Sentiment,” delivering normalized probability data feeds to institutional traders through the same infrastructure that distributes NYSE equity pricing. Polymarket’s crowd-sourced probability assessments now sit alongside securities pricing and corporate actions data in ICE’s Consolidated Feed. Then there are the defensive moves, which tell a different story. DraftKings acquired the CFTC-registered exchange Railbird. FanDuel partnered with CME Group. Both launched prediction market products specifically to capture volume in states where their sportsbook apps are illegal. These aren’t endorsements of prediction markets as a new asset class. They’re incumbents scrambling to avoid losing customers to a competitor with better regulatory positioning. The distinction matters because it cuts against the “Wall Street validates the productive thesis” narrative. Some of the capital flowing in is conviction. Some of it is fear of being left behind.
The productive speculation question
So. The question at the center of all of this. Are sports prediction markets “productive” speculation?
The case against is simple: nobody is hedging physical production. No farmer is managing crop risk. The underlying asset is entertainment, not commodities. You’re betting on whether the Chiefs cover the spread, not whether wheat prices will spike.
The case for is more nuanced, and I think it’s stronger than most DeFi analysts give it credit for. But it’s also weaker than prediction market boosters want to admit.
Start with the information argument. Prediction markets achieve Brier scores around 0.09, substantially outperforming polls and expert forecasts. Kalshi’s implied forecasts for East Coast snowfall in early 2026 proved more accurate than the National Weather Service’s own models. The closer these markets get to resolution, the more accurate they become, with Brier scores approaching 0.00-0.01 in the final days before settlement.
But accuracy alone doesn’t prove productive value. The Weather Channel is accurate too, and nobody calls it a capital market. The question is: who is actually consuming these signals and making better economic decisions because of them? The evidence is thin but growing. ICE distributes the data to institutional desks. ARK uses it for research. Networks embed it in coverage. These are real distribution channels, not hypothetical ones. But they’re mostly about sentiment and audience engagement, not classical hedging.
The actual hedging use case is just barely starting to emerge. In February 2026, Kalshi announced a partnership with broker Game Point Capital allowing professional sports teams to hedge the financial risk of performance-based bonus payouts. Better Markets, the financial reform advocacy group, argues there is “little if any credible evidence” that Americans use sports event contracts for hedging. They’re not entirely wrong, at least not yet.
Then there’s the vig argument. Traditional sportsbooks build a 4-10% margin into every line. They actively limit or ban winning bettors. Prediction markets operate with near-zero house edge, charging modest fees on settlement or trading volume. For sharp bettors, this is a fundamentally different proposition.
Except “peer-to-peer” deserves an asterisk. As Sportico has reported, platforms like Kalshi rely on institutional market makers, including major firms like Susquehanna, to fill contracts when there isn’t a natural counterparty. These market makers price contracts slightly above fair value, creating a spread that functions a lot like a vig, just a smaller one. Kalshi’s affiliated trading arm and its RFQ parlay system further complicate the pure P2P narrative. Users still almost always lose money in the long run, just like with sportsbooks. The losses are smaller, but the direction is the same. And if market-maker participation scales alongside volume, there’s no guarantee the cost advantage stays as wide as it is now.

The predation problem
A responsible analysis of this space has to name the risks without immediately deflecting to “but sportsbooks are worse.”
Start with access. Prediction markets are now available at age 18 in all 50 states, including jurisdictions where you can’t legally buy a beer until 21 or place a sportsbook bet at any age. That’s a massive expansion of access to leveraged financial risk for young adults, and it happened through regulatory classification rather than through any deliberate policy decision about whether 18-year-olds should have access to leveraged event contracts. Research on online sports betting generally suggests that roughly 1 in 5 online bettors, often young men, show signs of a gambling disorder. Prediction markets haven’t been around long enough to generate their own data on this, but there’s no reason to think the behavioral dynamics are fundamentally different.
The insider trading problem is more serious than a few bad actors. During Super Bowl LX, a rumor about whether Mark Wahlberg would attend the game drove more than $23.7 million in contract volume, pushing prices to 89% before collapsing when he didn’t show up. Separately, the Wall Street Journal reported that individuals at the University of Miami may have traded on inside information about Jeff Bezos’s attendance plans. Kalshi said it was investigating both cases. In the Venezuela prediction market incident, a well-timed trade on the U.S. capture of the country’s president raised immediate questions about non-public government information. These aren’t edge cases. They’re structural vulnerabilities of markets where outcomes are determined by private human decisions rather than public economic forces.

Where this goes
The near-term trajectory depends on courts and Congress.
If the Supreme Court affirms CFTC jurisdiction, prediction markets operate as a unified national market with lower barriers to entry than the current sportsbook regime. If Congress passes the “Prediction Markets Are Gambling Act,” the action migrates offshore and further onchain, to Polymarket’s international exchange, to fully decentralized protocols, to venues beyond U.S. jurisdictional reach. The demand doesn’t disappear. It finds the path of least resistance. It always does.
Multiple industry analyses point toward $1 trillion or more in annual prediction market volume by 2030, with sports accounting for roughly half. Weekly trading volumes already regularly exceed $5 billion, and the sector hasn’t yet experienced a FIFA World Cup cycle under its current regulatory posture.
Builders are already sketching a longer-term stack beyond binary prediction markets: sports perpetuals with leverage and funding rates (Levr Bet, backed by Blockchain Capital, is the most visible protocol), fan tokens with dynamic tokenomics tied to team performance (Chiliz CEO Alexandre Dreyfus described this in early 2026 as fan tokens becoming a hedge instrument alongside Polymarket contracts), and composability with the broader DeFi ecosystem through decentralized platforms like BetDEX and Divvy.bet. The fan token track record so far has been underwhelming, and the sports perps hedging use case remains theoretical. But the composability angle is worth watching: onchain sports positions that plug into lending protocols and yield strategies would represent something genuinely new, not just a cheaper sportsbook but an asset class integrated into a broader financial system.
What’s real right now is simpler than the vision: a faster, cheaper, more transparent alternative to legacy sportsbooks, with genuine information production baked in and institutional data infrastructure being built on top of it. Prediction markets charge 0-1% fees instead of 4-10% sportsbook vig. They’re accessible in all 50 states instead of 39. They settle onchain instead of in opaque house-held books. And they produce crowd-sourced probability estimates that consistently outperform expert forecasts.
Is that “productive” in the narrow sense of hedging physical commodity production? No. But neither is most of what we call finance. The global derivatives market runs in the hundreds of trillions, and the vast majority of it serves price discovery and risk transfer functions with no direct connection to physical production.
The more honest framing: prediction markets are less predatory, more efficient, and more informationally useful than the system they’re replacing. The hedging use cases are emerging but not yet at scale. The information signals are real but consumed more for sentiment than for risk management. The cost advantages are clear but narrower than the “peer-to-peer” marketing suggests. The insider trading and access risks are structural and underaddressed.
That’s a messier thesis than “sports betting is productive speculation.” It’s also one the data actually supports. The line between productive and predatory isn’t a line at all. It’s a gradient, and crypto-native sports markets are somewhere in the middle, moving in the right direction, not yet at the destination.
Whether they get there depends less on the technology and more on whether the industry builds adequate safeguards before the harm accumulates faster than the benefits. I think the honest version of this argument is harder to dismiss than the hype version. But it also demands more from the builders.
